Our Service

We offer two services:

• Bespoke design (Concierge). We design a custom itinerary for you, including recommended hotels, experiences, restaurants, and logistics. You pay a non-refundable design fee. We deliver the design as a written itinerary and continue to refine it through the trip date.
• Signature trips. We publish curated multi-night itineraries (such as Capital y Corazón, Colonial Heart, and Oaxaca Bespoke Excursion). For signature trips, we provide the design and the introductions. You book directly with the suppliers and pay them directly. MexicoNow does not collect any portion of the trip cost.

Concierge Design Fee

The Concierge design fee is non-refundable upon engagement, except where required by law. We will deliver the design as described in our written engagement. The fee covers our design work and does not cover any trip costs paid to third parties.

Signature Trips and Third-Party Suppliers

For signature trips, all bookings and payments are between you and the third-party suppliers we introduce you to. Their terms and conditions, cancellation policies, and consumer protections — not ours — govern those bookings. We will introduce you, share information you authorize us to share, and remain available to support the design throughout. We are not responsible for the performance, conduct, cancellation, refund, or any other obligation arising between you and a supplier. You agree to address such issues directly with the supplier.

Travel Documents, Health, and Safety

You are responsible for ensuring you have valid travel documents (passport, visa, vaccination records as required by Mexican authorities or your country of origin), the travel insurance you find appropriate, and a current understanding of any travel advisories. We will share with you what we know, but we are not your legal, medical, or travel insurance advisor. Mexico is a sovereign country with its own laws, customs, and risks. You travel at your own risk.

Pricing and Currency

Prices we quote are estimates based on supplier rates at the time of quotation and are subject to supplier confirmation and currency fluctuation. The price you ultimately pay is governed by your direct relationship with each supplier.

Intellectual Property

The website, brand mark, content, photography, copy, and trip designs on mxnowtravel.com are the property of MexicoNow or our licensors and are protected by U.S. copyright and trademark law. You may not copy, reproduce, distribute, or create derivative works from our content for commercial purposes without our written consent. Personal, non-commercial use — such as printing your own itinerary for your own travel — is permitted.

Disclaimer of Warranties

Our services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that the information on the site is accurate, complete, or current.

Limitation of Liability

To the maximum extent permitted by law, MexicoNow’s total liability to you for any claim arising out of these Terms, your use of our site, or your engagement of our services is limited to the amount you paid us as a Concierge design fee in the twelve months preceding the claim. We will not be liable for indirect, incidental, consequential, or punitive damages of any kind, including lost profits, lost data, or loss of enjoyment, even if advised of the possibility of such damages.

We are not liable for the acts or omissions of any third-party supplier, for force majeure events (natural disasters, civil unrest, government action, pandemics, supplier insolvency), or for any harm arising out of travel itself.

Indemnification

You agree to indemnify and hold harmless MexicoNow, its owners, employees, and agents from any claim arising out of your conduct during travel, your interactions with third-party suppliers, your violation of these Terms, or your violation of applicable law.

Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona without regard to its conflict of laws provisions. Any dispute arising out of these Terms or our services will be resolved exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date above will reflect any changes. Continued use of our site or services after a material change constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full effect.
